These Terms of Service (the "Terms") for the BEENS platform are applicable to all users accessing or utilizing the platform as a User, Host, or any other role or designation therein. The Terms are structured to be legally robust, globally applicable, and scalable with evolving regional compliance, platform functionalities, and community conduct policies.

Match Group Marketing Co., Ltd. is committed to protecting user rights, enforcing community standards, and operating within the law across all markets in which it operates. These Terms govern your access to and use of the BEENS platform and related services. Please read them carefully.

By accessing or using BEENS, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you may not use the platform. Match Group may update these Terms from time to time to reflect operational, legal, or regulatory changes. Continued use after such updates constitutes your acceptance of the revised Terms.

01 Introduction & Scope

Welcome to BEENS. By using our services, you agree to abide by the terms outlined herein, which govern your access to and use of the BEENS platform including all related applications, websites, communications, software, and associated services. These Terms form a legally binding agreement between you and Match Group Marketing Co., Ltd. ("Match Group", "BEENS", "we", "our", or "us"). Your electronic acceptance of these Terms constitutes a legally binding agreement in accordance with applicable electronic transaction laws.

BEENS facilitates live experiences between individuals (Users) and service providers (Hosts) through paid activities (Plans). Our platform leverages marketplace mechanics to enable safe and dynamic engagement. This agreement applies globally except where superseded by specific regional Terms or jurisdictional laws.

02 Account Creation & Eligibility

To use BEENS, you must register and maintain an active account. By creating an account, you affirm that you:

  • Are at least 18 years old.
  • Have not been suspended or removed from any prior BEENS-related platform or partner service for policy violations.
  • Provide accurate, current, and complete information upon registration and update it as necessary.
  • Are solely responsible for maintaining the security of your login credentials and all activity conducted under your account.

Identity Verification (KYC)

To ensure platform safety, certain features and roles require identity verification. You agree to undergo a "Know Your Customer" (KYC) process facilitated by our third-party verification partner. This process may involve submitting government-issued identification or other documentation. Access to specific platform functionalities is contingent upon successful completion of this verification.

03 Role Definitions & User Types

The BEENS platform supports various user roles. Users may hold dual-ended roles depending on the nature of their interaction (e.g., acting as a User in one instance and a Host in another). Additional requirements, background checks, or verification may apply depending on the selected role.

  • User: A registered user who purchases access to Plans (paid activities) with other users.
  • Host: A registered user who manages a Plan for paying users.

04 Platform Functionality

BEENS offers a digital marketplace and communication system that allows users to:

  • Create and manage Plans with unique offerings (e.g., "Pitch Review Session for Founders").
  • Pay to join Plans (one-time or recurring activities).
  • Interact through a secure, in-app messaging system.

Functionality may evolve based on regional availability, regulatory compliance, and new feature development.

05 Acceptable Use Policy

Users agree not to misuse the BEENS platform. The following are explicitly prohibited:

  • Harassment, stalking, or targeted abuse.
  • Use of AI bots, spam accounts, or automation tools.
  • Misleading impersonation, identity theft, or fraudulent representation.
  • Posting or facilitating illegal services.
  • Commercial activity not permitted under the platform's guidelines.
  • Sharing of misinformation or non-consensual media.
  • Creation or use of fake accounts, false identities, or misleading profile information.
  • Using the platform to mislead, deceive, or financially exploit other users (Fraud and Scam Prevention).

Violations may result in account suspension, removal, or legal escalation.

Cooperation with authorities

Match Group may cooperate with law enforcement or relevant government authorities and disclose necessary user or transaction information when required by law or investigating unlawful activities on the platform.

06 Community Guidelines & Safety

To protect the integrity of the BEENS community, users must uphold respectful, lawful, and safety-oriented behavior both online and in-person. These guidelines apply universally, regardless of region or user role.

6.1 Zero-Tolerance Policy

BEENS maintains a strict zero-tolerance policy regarding objectionable content and abusive behavior. Users are prohibited from creating any content or Plan that is defamatory, obscene, harassing, threatening, or otherwise offensive. This includes hate speech, discrimination, or abuse based on race, gender, sexual orientation, nationality, disability, or appearance. Any violation is grounds for immediate account removal.

6.2 Standards of Conduct and Consent

Consent is paramount in all interactions on the platform.

  • Harassment: Users must avoid all forms of verbal, physical, or digital harassment.
  • Coercion: Users may not pressure, guilt, or coerce others into any form of interaction or spending.
  • Prohibited items: Firearms, weapons, or other dangerous tools are strictly prohibited during any interaction.
  • Substances: Alcohol and drug use during Plans must comply with applicable local laws and platform restrictions. BEENS does not condone illegal substance use.

6.3 In-Person Interaction Safety

For all in-person Plans, Hosts are responsible for confirming the location, timing, and nature of the activity beforehand. Users are encouraged to meet in public spaces and must immediately report any suspicious behavior through the platform's safety tools.

6.4 Sensitive and Adult Content

BEENS strictly prohibits nudity, sexual conduct, or adult-oriented content of any kind. This includes Plans involving sexual services, escort services, or any sexually suggestive behavior. Any violation will result in immediate and permanent account termination.

6.5 Safety Mechanisms

  • Flagging and reporting: Users can report any Plan, profile, or message that violates these terms via the in-app "Report" feature.
  • Blocking: Users can instantly block any other user via their profile, which will hide all interactions and content from that user immediately.

6.6 Content Moderation

BEENS reserves the right to review and remove any user-generated content that violates these Terms. Content reported as objectionable will be reviewed by our team and, if found in violation, removed from the platform within 24 hours.

6.7 Account Termination

Any user found to be engaging in abusive behavior, violating consent standards, or repeatedly posting objectionable content will be subject to immediate account suspension or permanent removal at our sole discretion.

07 Booking & Transactions

When booking a Plan, users enter into a binding commitment with the Host. The following governs transactional interaction:

  • Plans may be fiat-priced depending on the Host's settings.
  • Cancellations, refunds, or no-shows are governed by the Plan's stated terms. BEENS will review all disputes in accordance with applicable platform policies and reasonable consideration of both the User's and Host's circumstances.
  • Participation must occur within the boundaries of the Plan's description. Unauthorized recording, resale, or third-party redistribution is prohibited.
  • Repeated failure to attend or fulfill a booked Plan may result in penalties or account limits.

08 Pricing, Fees & Taxes

BEENS operates on a freemium subscription model. Current pricing for all tiers is displayed clearly within the application at the point of purchase.

  • Free: The standard entry point for all users. Includes public discovery, a public profile directory, and access to limited or standard public Plans.
  • BEENS Elite ($20/month): A premium access layer for high-value individuals, reputable creators, and insiders. Includes Private Mode (full access with profile and Plans hidden from the public), ability to host and access Black-only Plans, enhanced discovery visibility with a Black badge, and access to bidding experiences and advanced filtering for better matches.

Membership Approval

BEENS Black is a manually curated network. Access is granted through paid subscription, in-app application, or invitation from existing members. All users are subject to approval to maintain network quality.

Price Changes

We reserve the right to modify subscription fees at any time. Any price changes will apply to the next billing cycle following notice to the user.

Taxes & Earnings

All purchases are subject to applicable taxes based on your region. BEENS charges various fees, including subscription fees and transaction fees, which are detailed at the point of sale. Where Match Group is the operating entity in Thailand, tax obligations are governed by Thai law and the VAT on Electronic Services framework. Users earning through the platform (Hosts) are responsible for all personal income tax and VAT liabilities on their earnings. Tax documentation, where required, will be issued in accordance with the legal status of the operating entity.

09 Bid-based Participation

BEENS features a native bidding system for custom Plans:

  • Users may place bids on upcoming Plans to increase chances of their application being approved.
  • Hosts may set minimum bid thresholds, time windows, or accept/reject any bidder.
  • Bids are not donations and do not guarantee acceptance. Unsuccessful bids are refunded as per policy.

10 Intellectual Property

All content, branding, platform code, media, and user interface designs are the exclusive property of BEENS or its licensors, unless otherwise indicated. Users agree not to reproduce, distribute, or modify any proprietary content without express authorization.

  • By uploading or sharing content on the platform (including media, text, audio, or video), users grant Match Group and BEENS a worldwide, non-exclusive, royalty-free license to use, modify, distribute, and display such content solely for purposes reasonably connected with the operation, service provision, content moderation, platform promotion, and technical operation of the platform. This license terminates upon the user's deletion of the content or termination of the account, except to the extent the content has been previously shared with others or retention is required for legal or regulatory compliance.
  • Users may not use the Match Group or BEENS names, logos, or brand assets without prior written permission.
  • All custom icons and platform-specific visual elements are protected under intellectual property law.

11 Privacy & Data Use

Match Group collects, processes, and stores user data in accordance with its Privacy Policy. By using the platform, you consent to:

  • The collection of data necessary for account functionality, security, and platform optimization.
  • The storage and processing of data in jurisdictions where Match Group or its partners operate.
  • The sharing of anonymized or aggregate data with third-party analytics platforms.
  • Communication via email, app notifications, or SMS for service-related updates.

Users have the right to access, correct, or delete their personal data within the bounds of legal and operational requirements.

PDPA compliance & user rights

In Thailand and other markets where the Personal Data Protection Act (PDPA) applies, Match Group processes data based on clear legal bases — contractual necessity, legitimate interest, or explicit consent for sensitive personal data such as biometrics. For data protection matters, users may contact our Data Protection Officer at daisy@matchthailand.com. In the event of a personal data breach, Match Group will notify users and regulators where required under applicable law.

12 Third-Party Services

BEENS may integrate with or refer to third-party platforms (e.g., payment processors, mapping services, messaging APIs). By using such services:

  • Users agree to abide by the terms and conditions of the respective third parties.
  • Match Group is not responsible for outages, breaches, or changes in policy from these third-party providers.
  • Integration does not imply endorsement.

13 Disclaimers & Assumption of Risk

BEENS is a digital marketplace that facilitates paid offerings via Plans between users and service providers. As such:

  • We do not guarantee the accuracy, quality, or fulfillment of any user-created Plan.
  • Users assume full responsibility for their interactions, both online and in-person.
  • Match Group disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
  • We do not screen all users beyond base verification; caution and discretion are advised.

14 Indemnification & Liability

By using BEENS, you agree to indemnify and hold harmless Match Group Marketing Co., Ltd. and its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms.
  • Your violation of any law or rights of a third party.
  • Any content you submit, post, or transmit.

Match Group's liability in connection with the platform is limited to the amount you have paid us in the last 12 months. We are not liable for indirect, incidental, or consequential damages. This limitation does not apply in cases involving fraud committed by Match Group.

15 Termination & Suspension

Match Group reserves the right to suspend, restrict, or terminate any user account at its discretion, with or without notice, for:

  • Violations of these Terms or community guidelines.
  • Fraudulent or abusive behavior.
  • Inactivity or regulatory risk.

Users may request account closure at any time. Upon termination, all in-platform access and Plan listings will be forfeited.

16 Dispute Resolution & Arbitration

16.1 Informal Resolution

For any issue related to payments, subscriptions, or service quality, you must first attempt to resolve the matter by submitting a support ticket through the app's help center. This ticket is automatically routed to our internal support team for review.

16.2 Payment and Refund Disputes via Xendit

BEENS uses Xendit as our Payment Service Provider (PSP). All payment-related disputes and refund requests are governed by Xendit's regional processing standards and documentation.

  • The process: Once you submit a support ticket, our team will investigate the transaction and, if necessary, coordinate with Xendit for technical resolution. This includes specific handling for eWallet voids or dashboard-processed refunds as required by the payment method used.
  • Timeline: We will communicate Xendit's final decision to you as soon as it is cleared. The window for funds to appear in your account after a refund is approved varies by payment method (e.g., eWallets or credit cards) and is typically subject to Xendit's standard processing cycles of 5 to 10 business days.

16.3 Formal Arbitration

If the dispute remains unresolved after 60 days of informal negotiation, it shall be submitted to and finally resolved by binding arbitration under the rules of the International Chamber of Commerce (ICC). Proceedings will be held in Bangkok, Thailand, or another mutually agreed location.

16.4 Class Action Waiver

You agree to resolve all disputes on an individual basis. You explicitly waive the right to bring any claim as a plaintiff or class member in any purported class, collective, or representative proceeding.

17 Regional Disclosures

Depending on your region, supplemental terms may apply. These will be provided at registration or notified via update.

Thailand implementation measures

For transactions within Thailand, the validity of electronic agreements is secured through platform measures including clickwrap acceptance mechanisms, storage of records of user consent (date, time, user account, IP address), version control of legal documents, and secure retention of electronic evidence for key transactions (such as bookings and payments), as required by the Electronic Transactions Act.

18 Updates to These Terms

Match Group reserves the right to amend these Terms at any time. Updates will be posted on our website and notified via email or in-app alerts. Continued use of the platform after updates constitutes acceptance of the new Terms.
